1. 协议范围
本协议是你与 MoTalk（motalk.app，以下简称"平台"）之间的法律协议。注册或使用本服务即表示你已阅读、理解并同意本协议及《隐私政策》。你必须年满 18 周岁。
2. 账号与注册
- 你需提供真实有效的邮箱并对账号活动负责。
- 一人一号，禁止买卖、出租账号。
- 性别信息用于匹配与收益规则，注册后不可自行更改。
- 发现账号被盗请立即联系 [email protected]。
3. 用户行为规范
你承诺不发布、不传播以下内容：
- 违法、暴力、恐怖主义、仇恨言论内容；
- 色情、性暗示或裸露内容（含未成年人相关的任何内容，零容忍）；
- 骚扰、辱骂、威胁、跟踪他人；
- 诈骗、钓鱼、传销、赌博、洗钱行为；
- 冒充他人或虚假身份（含虚假认证照片）；
- 垃圾广告、刷屏、引流至站外交易；
- 侵犯他人知识产权、隐私权的内容。
违规处理：我们采取"警告 → 限制功能 → 永久封禁"阶梯处理。涉及违法内容将直接封禁并依法上报。未消费金币余额在违规封禁时不予退还。
4. 用户内容与平台权利（UGC）
- 你保留所发布内容的著作权，但授予平台在全球范围内为提供服务所需的展示、存储、转码、翻译的非独占许可。
- 内容审核：平台采用机器审核 + 人工复审，可能删除违规内容。
- 举报机制：每条动态/消息/用户主页均有举报入口，我们承诺 24 小时内处理。
- 屏蔽功能：你可随时拉黑任何用户，拉黑后双方不可见、不可联系。
5. 付费服务
- 金币：虚拟货币，用于发消息、语音/视频通话、送礼物。金币仅限平台内使用，不可兑换回法币、不可转让、充值后不予退款（法律另有规定除外）。
- VIP 订阅：按月付费，解锁查看访客、视频内容、AI 功能等权益。通过应用商店订阅的，取消与退款遵循 Apple / Google 的订阅规则。
- 女性用户收益：认证女性用户可通过聊天回复、通话、礼物获得收益分成，收益由平台线下结算，平台依法代扣相关税费。收益资格以真人认证通过为前提。
- 推广返佣：推广员按规则获得邀请充值返佣，禁止自刷、作弊，违者清零并封禁。
- 支付由 Stripe / PayPal / 应用商店处理，支付争议依其规则处理。
6. AI 功能说明
- AI 助聊、破冰、润色由第三方大模型生成，内容仅供参考，平台不保证其准确性。
- 自动翻译可能存在误差，请勿依赖翻译进行法律、医疗、金融等重要决策。
- 你使用 AI 生成的文案仍须符合第 3 条规范，责任由发布者承担。
7. 知识产权
平台的商标、界面、代码、礼物设计等知识产权归 MoTalk 所有。未经授权不得复制、抓取或反向工程。
8. 免责声明
- 平台提供信息发布与社交技术服务，不对用户间线下见面的行为负责。请勿向陌生网友转账汇款。
- 因不可抗力、第三方服务故障导致的服务中断，平台不承担赔偿责任。
- 平台对用户生成内容不承担事前审查义务，但保留处理权利。
9. 服务终止
- 你可随时在「我的 → 隐私与安全」注销账号。
- 严重违规时平台可不经通知直接终止服务。
10. 法律适用与争议解决
本协议适用平台运营主体所在地法律。争议应先友好协商；协商不成提交平台运营主体所在地有管辖权的法院/仲裁机构。
11. 协议变更
协议变更将在应用内公告，继续使用视为接受变更。

1. Scope
This is a legal agreement between you and MoTalk (motalk.app, the "Platform"). By registering or using the service you accept these Terms and the Privacy Policy. You must be at least 18 years old.
2. Account
- Provide a valid email and keep your credentials secure.
- One account per person; selling or renting accounts is prohibited.
- Gender is used for matching and revenue rules and cannot be changed after registration.
- Report account theft to [email protected] immediately.
3. Code of Conduct
You agree NOT to post or transmit:
- Illegal, violent, terrorist or hateful content;
- Pornographic, sexually suggestive or nude content (zero tolerance for anything involving minors);
- Harassment, abuse, threats or stalking;
- Fraud, phishing, pyramid schemes, gambling or money laundering;
- Impersonation or fake identity (including fake verification photos);
- Spam, ads, or redirecting users to off-platform transactions;
- Content infringing others' IP or privacy rights.
Enforcement: warning → feature restriction → permanent ban. Illegal content results in immediate ban and reporting to authorities. Unused coin balances are forfeited on violation bans.
4. User Content (UGC)
- You keep copyright of your content but grant us a non-exclusive worldwide license to display, store, transcode and translate it as needed to operate the service.
- Moderation: machine review plus human re-review; violating content may be removed.
- Reporting: every post, message and profile has a report entry; we commit to handling reports within 24 hours.
- Blocking: you may block any user at any time; blocked users cannot see or contact each other.
5. Paid Services
- Coins: virtual currency for messaging, voice/video calls and gifts. Coins are usable only within the Platform, cannot be redeemed for fiat, cannot be transferred, and are non-refundable unless required by law.
- VIP subscription: monthly, unlocking visitors, video content, AI features, etc. Subscriptions purchased via app stores follow Apple / Google subscription rules for cancellation and refunds.
- Creator earnings: verified female users may earn revenue share from replies, calls and gifts; earnings are settled offline by the platform after identity verification, and applicable taxes are withheld by law.
- Promoter rebates: rebates on referred recharges per program rules; self-dealing or fraud leads to forfeiture and ban.
- Payments are processed by Stripe / PayPal / app stores; payment disputes follow their rules.
6. AI Features
- AI chat-assist, ice-breaker and polish are generated by third-party models; accuracy is not guaranteed.
- Auto-translation may contain errors — do not rely on it for legal, medical or financial decisions.
- AI-generated text you publish must still comply with Section 3; you bear responsibility for what you publish.
7. Intellectual Property
The Platform's trademarks, UI, code and gift designs belong to MoTalk. No copying, scraping or reverse engineering without authorization.
8. Disclaimers
- The Platform provides social technology services and is not responsible for offline meetings. Never transfer money to strangers.
- We are not liable for interruptions caused by force majeure or third-party failures.
- We do not pre-review user content but reserve the right to act on it.
9. Termination
- You may delete your account anytime in "Me → Privacy & Safety".
- Serious violations may lead to immediate termination without notice.
10. Governing Law
These Terms are governed by the law of the operating entity's jurisdiction. Disputes shall first be negotiated in good faith; failing that, submitted to the competent court or arbitration body at the operating entity's location.
11. Changes
Changes will be announced in-app; continued use constitutes acceptance.
